Accepting these terms
By using preqly.com, app.preqly.com, or the Preqly application, you agree to these terms and to our Privacy Policy.
You must be able to form a contract (in most cases, 18 or older). If you use Preqly for a company or as a partner, you confirm you are allowed to bind that business.
We record acceptance when you use the site or when you check the box on the apply form. Keep a copy of these terms for your records.
What the service is
Preqly verifies income and assets from connected financial accounts and issues a pre-approval letter. Preqly LLC is not a lender, creditor or mortgage broker. Loan products are offered through partnerships with federally chartered banks and lenders. Licensing and disclosures.Eligibility
You must be at least 18, live in the United States, and provide accurate information. The service is for people exploring a mortgage pre-approval letter, and for partners we invite. If you do not meet these criteria, or you submit false information, we may refuse a letter, close access, and decline to work with you. A letter is not available in every situation even if you are eligible to use the site.Your account
Some features (including the partner portal) use a login. You are responsible for the email, phone, and password you use and for activity under that login. Tell us at [email protected] if you think someone else used your login. Applying for a letter is not a bank account. You may stop using the site at any time. We may close or suspend access if these terms are broken, if we must for legal or security reasons, or if we discontinue the service.Accuracy of information
You agree that the information you submit, and the accounts you choose to connect, are accurate and yours to use. If that information is wrong, incomplete, or out of date, the letter can be wrong. We may decline, expire, or reissue a letter when we learn of an error. We are not responsible for a letter that is inaccurate because of information you or a connected institution provided.Nature of a pre-approval letter
A pre-approval letter is a verified qualification. It is not a commitment to lend, a locked interest rate, or final underwriting approval. Final approval follows underwriting and an appraisal on a specific property, and your credit and employment are reviewed again before closing. Letters carry an expiry date and may be reissued with refreshed data. Program guidelines, fees and limits are set by the applicable agencies and lenders and change over time.Partner lenders and third parties
If you continue with a loan, the lending relationship is with the partner lender, not Preqly LLC. Preqly is not a lender, creditor, or mortgage broker. That lender’s own applications, credit pulls, and terms apply. The service uses third parties, including Plaid for read-only bank connection, hosting, email/SMS, and analytics. Their terms and privacy policies apply when you use those services. Links to other sites are not an endorsement; those sites have their own terms.Intellectual property
The site, the application, the letter format, and the Preqly name and logo are owned by Preqly LLC or its licensors.
We give you a limited, revocable, non-exclusive right to use the site for your own lawful pre-approval or partner use. You may not copy, scrape, resell, reverse engineer, or use our marks without written permission, except as the law allows.
Acceptable use
You may not:
- Submit false, stolen, or misleading information
- Connect accounts you are not authorized to use
- Scrape, probe, or overload the site, or reverse engineer the application
- Interfere with security or other users
- Use Preqly for any unlawful purpose
We may suspend or terminate access, withhold or revoke a letter, and report conduct when we have a good-faith reason to do so.
Disclaimers
The service and any letter are provided as is and as available. We do not warrant that the site will be uninterrupted, error-free, or that a letter will result in a loan.
A Preqly letter is a verified qualification, not an offer of credit, a locked rate, or a commitment to lend. Partner lenders make their own decisions. Nothing on the site is legal, tax, or financial advice.
Some states do not allow certain disclaimers. Where those rules apply, the disclaimer is limited to the extent the law requires. Nothing in these terms is meant to limit rights you have under fair lending or other consumer financial laws that cannot be waived.
Limitation of liability
To the fullest extent the law allows, Preqly LLC and its officers, employees, and partners are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or a failed home purchase or refinance, arising out of your use of the site or a letter.
If we are liable despite that, our total liability for any claim is limited to the amount you paid us for the service in the 12 months before the claim (the consumer pre-approval is free, so that amount may be zero), except where the law says we cannot limit liability.
Some states do not allow these limits. In those states, our liability is limited only as far as the law permits.
Disputes and governing law
These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. You and Preqly agree that disputes will be resolved in state or federal courts located in Illinois, unless a law that cannot be waived requires another place. We are not adding an arbitration clause or class-action waiver here. Counsel can add those later if you want them; they have to be presented clearly to have a chance of being enforceable.Termination
You may stop using Preqly at any time. We may suspend or end access as described above. Sections that should survive include: the nature of the letter, intellectual property, acceptable use, disclaimers, limitation of liability, disputes, and this survival sentence.Changes to these terms
We may update these terms. The Last updated date at the top of this page will change when we do.
Material changes will be posted on this page. We may also email you or show a notice when the law requires it. Continued use after the updated date means you accept the revised terms. If you do not, stop using the site and contact us.
